Wished Munyaneza
Désiré Munyaneza (born in 1966) is a citizen Rwanda is currently judged with the Canada. It was stopped by the royal Gendarmerie of Canada (Section of the war crimes to Division A) on October 19th, 2005 with Toronto, after five years of investigation.
Désiré Munyaneza was the first man shown under the terms of the Loi on the crimes against the humanity and the war crimes , or Loi of universal Compétence , promulgated in October 2000, following the ratification of the Statute of Rome of the International penal court by the Canada.

Désiré Munyaneza is shown to have taken part in the Rwandan genocide. The bill of indictment relates to events to Butare, the Rwanda, between on April 1st, 1994 and on July 31st, 1994. Désiré Munyaneza deals with seven charges under the terms of the Loi on the crimes against the humanity and the war crimes :

An ordinance of not-publication prohibits the disclosure of the names of the witnesses. The defendant saw himself refusing the release on parole pending the lawsuit and will remain held during all the procedures. The lawsuit will proceed in front of judge alone and in English at the Superior court of Montreal as of the month of March 2007.
The legal district of Montreal was selected like place of the lawsuit. The lawsuit began on March 26th, 2007, it can be followed on the site of the Think tank in penal and humane international law of the Université from Quebec in Montreal.

Désiré Munyaneza would have passed by Kenya and Cameroun before coming to Montreal. His wife would have joined it a little later with her daughter. The family lived in Toronto.
A decision of September 20th, 2000 refused the application of statute of refugee of Desired Munyaneza in Canada, under the terms of the clause of exclusion of article 1 F (A) of Relative convention to the statute of the refugees. It was débouté twice in judicial control. January 24th, 2001, a request for authorization to present a request for judicial control of the unfavourable decision of the court was rejected. Another action of the applicant was brought in September 2001, for a reopening of the audience relating to its claim of the statute of refugee while being based on what was presented like new pieces of evidence. November 21st, 2001, the Section of the statute of refugee rejected the request of the applicant. This request was examined and rejected by a second court differently made up. Finally, following an audience on November 6th, 2002, a request for judicial control of the decision not to reopen the audience relating to its claim of the statute of refugee was rejected.
