Regulatory agency of the electronic communications and the stations

Born the January 5th 1997 under the name of Regulatory agency from telecommunications ( ART ), the Regulatory agency of the electronic communications and the stations ( ARCEP ) is an organization French charged to control the Télécommunications. Initially composed of five members, it is now, since 2005, composed of a college of seven members: three of them are indicated by the president of the Republic and the four others, respectively, by the president of the National Assembly and the president of the Senate.

Its activities go from the delivery of license for independent networks to the sanction in the event of infringement.

Its current president is Paul Champsaur.

The ARCEP has a statute of independent administrative authority. In spite of that, because of designation of these members by the political world, she does not escape the supervision from the government.

Into 2005, ART changed name and became the ARCEP, the regulatory agency of the electronic communications and the stations : in addition to the regulation of the télécoms, the organization will have to regulate the sector of the stations, called to open with competition from here with 2009.

The ARCEP made up of 7 services, each one is specialized in the treatment of a certain type of questions. In complement from the seven " collégiens" who are the Authority strictly speaking, the ARCEP counts approximately 150 people.

It has many powers to control, of sanction and settlement of the disputes between operators of networks and electronic departments of communication. Its decisions raise to some extent of the administrative and legal judge (Court of Appeal of Paris). It regulates also the litigations of interconnection and access of the operators to the networks.

At the European level, she collaborates within the network IRGIS.
