Raymond-Theodore Troplong
Raymond-Theodore Troplong (born the October 8th 1795 with Saint-Gaudens - died on March 1st 1869) was a lawyer and French politician of the 19th century.
Raymond-Theodore Troplong became lawyer in 1819.
In 1835, it is named to advise with the Court of appeal.
In 1840, he becomes member of the Institut of France, Academy of Science morals and political (Législation section)
In 1846: It is high with the dignity of Pair of France.
In 1852, he becomes president of the Court of appeal.
Joint editor of the initial text of the Constitution, it is named senator the January 23rd 1852. He was rapporteur of the Sénatus-consulte restoring the Empire, he showed theoretical subtleties to legitimate the Coup d'etat of Napoleon III:
- “the Republic is virtually in the Empire because of the contractual character of the institution and the communication and the delegation express of the capacity by the people; but the Empire overrides the Republic because it is also monarchy, i.e. the government of all entrusted to the moderating action of only one with heredity for condition and stability for consequence”
It replaced the prince Jerome Bonaparte when this one resigned of its position of president of the Sénat the December 30th 1852. It preserved this function during practically all the Second Empire, until its death in 1869.
In 1858, it is named by a decree of the member of the private Council of the Emperor
Raymond-Theodore Troplong, who was one of the principal lawyers of his time - it was described as “Portalis of the Second Empire” - was the author of many works of right, in which it defended a concept of the right which made a very broad place being studied of the Philosophie and Histoire. He knew and discussed work of Friedrich Carl von Savigny, the founder of the German École historical of the right , and defended of the close positions but distinct, which seems to prove, as opposed to what could say certain authors (Julien Bonnecase, the École of Interpretation in Civil law , 1924) whose influence on the French doctrines legal is still felt nowadays, the existence and the fruitfulness of a French École historical of the right , whose influence is far from being marginal.
Writer with the appreciated style, it was on the other hand a poor fort speaker, which was worth to him the sarcastic remarks of Prosper Mérimée: “Our president, so precisely named Troplong…”.
