Minister of Justice

In France, the Minister for Justice carries the double title of Minister of Justice, Minister for Justice , usually shortened, in the language running, in Minister of Justice . Since May 18th, 2007, it Minister of Justice is Rachida Dati.

Functions

The Minister for justice proposes the criminal laws and civil. Its services inform the demands for grace, and manage the administrative operation of justice (buildings, funds, staff management). The minister with the supervision on the parquet floor, i.e. services in charge of the continuations.

The magistrates of the seat, i.e. in particular those which judge the businesses, are independent of the Minister for justice. This one, not more than whoever, cannot return them, promote them or transfer them without their assent.

Minister of Justice

Historically, a Sceau authenticated the royal or last acts in the name of the monarch. The Justice was returned (by the Parlements, the Baillifs, Seneshals, etc according to the systems) in the name of the sovereign. Any decision of Justice carried a seal authenticating it.

The function of Minister of Justice was created by Philippe Auguste. July 3rd, 1194, Philippe Auguste faces Richard Lion-hearted with the accesses of the forest of Fréteval (close to Vendôme). Richard inflicts a demolished cuisante to him, at the conclusion which the king of France loses his crews, his Trésor and its Archives. Philippe Auguste was constrained to reconstitute its files and entrusted this mission to Nicolas Guerin, bishop of Senlis, which created the treasure of the Charters where were deposited from 1195 the registers and particular Archives of the royal crown. Philippe Auguste made raise Nicolas Guerin in 1203 with the dignity of Minister of Justice, in responsibility of preserve the seals and the royal archives.

Chancellor of France was equivalent of minister of justice, and exerted, at least until in 1718 (date from which the functions were separate), the function of Minister of Justice of France.

Today it is not any more the king but the French people which are sovereign. Any legal decision thus goes in the name of French people (this formula is in fat and in capital letters on any decision of Justice) but the formula Minister of Justice , designating the holder of the capacity to authenticate a decision like catch in the name of the sovereign, is remained. The Minister of Justice is always agent of the seal of the Republic called Grand seal of France, which is nowadays used only to seal certain constitutional acts.
