Laurent Davenas

French magistrate. Laurent Davenas, wire of magistrate, made all his career with the parquet floor.

Course

1971: In Mulhouse, it poses on the desk of the public prosecutor an ox nerve seized in a prison warder.

1970s Beginning: Versailles.

1978: parquet floor of Paris. chief of the eighth section, in charge of the obvious crimes and offenses.

1987-1990: general substitute at the Court of Appeal.

1990: Public prosecutor of Evry (the Essonne). It is made affect a chauffeur-driven car by the president of the general advice, Xavier Dugoin (RPR) whereas the regional court of the accounts criticizes the management of the Essonne and suspects of the facts of corruption.

Fine 1990s: Laurent Davenas ends up engaging of the continuations against Xavier Dugoin and the general advice of the Essonne, under the control of the public prosecutor of Paris, Alexandre Benmakhlouf, former legal adviser of Jacques Chirac to the Town hall of Paris. He to him is reproached a too systematic recourse to the preliminary investigations, which allow the parquet floor and the political hierarchy to keep the control of the investigations by shorting-circuit the examining magistrate. It is in this context that the business of the helicopter occurs.

In 2001, the chancellery decides to transfer the Davenas prosecutor and his Dujardin assistant. Hubert Dujardin refused his promotion with the Court of Appeal of Versailles.

April 5th, 2001: Laurent Davenas is named Prosecuting attorney at the Court of appeal. Its successor, Jean-Michel Durand, Public prosecutor of Fatty was named in Evry one week before it officially left there.

The man of the helicopter

Seized of the famous report/ratio of Xavière Tiberi on the francophonie, Laurent Davenas orders a news Preliminary investigation and leaves on vacation in the Himalayas with some friends. Its assistant prosecutor, Hubert Dujardin, with which it has bad relations, benefits from his absence to open in November 1996 a Legal information and to entrust it to an examining magistrate.

In a climate of panic, the Minister of Justice Jacques Toubon (RPR) and Marc Moinard, old directing trade union close to ex-RPR, the Professional association of the magistrates (APM), dispatch in 1996 a helicopter in the Himalayas in order to find the Davenas prosecutor to avoid the opening of the legal information against the wife of the mayor of Paris Jean Tibéri.

The legal exit is without glory: the Court of Appeal of Paris finished on January 15th, 2001 by cancelling, for the third time, the continuations against Xavière Tiberi for problems of procedure with the awaited severe ones for the prosecutor of the Essonne Laurent Davenas.
