Homosexuality

French legislations successive

Since the French revolution (by the law of the September 25th - October 6th 1791) the crime of sodomy (i.e., homosexual reports/ratios into private between agreeing adults) does not exist any more in France.

This law will create an explicit distinction, one can even say a discrimination, between homosexual reports/ratios and heterosexuals being sex acts with a minor (21 years for the homosexual reports/ratios and 15 years for the heterosexuals reports/ratios), because the age of sexual majority for the heterosexuals reports/ratios will be fixed at 15 years by an ordinance of the July 2nd 1945. After the Release, this subparagraph was not repealed as it was the case for a great number of laws signed under Vichy. Hardly modified, this paragraph was only moved with subparagraph 3 of article 331 of the penal code by ordinance 45-190 of the February 8th 1945. This new law punished … of a six months imprisonment to three years and of a fine of 60 francs to 15.000 francs whoever will have made an act impudic or against nature with an individual of its minor sex of twenty and one years. (Official journal, February 8th 1945)

In 1974, the age of sexual majority for the homosexual reports/ratios was lowered to 18 years (with the law of the July 5th 1974, which changed the age of 21 years majority to 18 years in all the articles of the civil code and the penal code). With this modification, subparagraph 2 of article 331 remained in the penal code until the August 4th 1982 (Official journal, August 5th 1982). It is Robert Badinter which, then Minister for Justice, will declare the right to homosexuality.

Moreover, there were only two laws to make an explicit mention with homosexuality in France since the Revolution. There was thus article 331 described above, but also the law of the November 25th 1960 (creating subparagraph 2 of article 330 of the penal code) which doubled the sorrow minimum for public insult with decency when they were homosexual reports/ratios (this law was removed by the law of the December 23rd 1980).
