Commission of regulation of energy
The commission of regulation of energy ( CRE ) is a independent Administrative authority French, created the March 24th 2000 and charged taking care of the good performance of the market of the energy and with arbitrating the disagreements between the users and the various owners. Its competence of regulator extends to the markets from the Gaz and the electricity.
The institution of this commission was born from the laws of the February 10th 2000, relating to the modernization and the development of the public service of electricity, and the January 3rd 2003, relating to the markets of the gas and the electricity and with the public service of the energy, which transposed to France the European directives from the December 19th, 1996 and of June 22nd, 1998. The second law opened the market of gas and extended to this sector the capacities of which the CRE had already on the market electricity.
These directives, constituting the “package energy”, organize the opening of the energy market at community level, while envisaging:
- for the consumers, the free choice of the supplier,
- for the producers, the freedom of establishment,
- and for the distribution networks and of transport, the right of access under objective, transparent and nondiscriminatory conditions for all the users.
According to the law of December 7th, 2006, " the Commission of regulation of energy contributes, for the benefit of the ultimate consumers, the good performance of the markets of electricity and natural gas. It takes care, in particular, so that the access terms with and the distribution grid systems of electricity and natural gas do not block the development of competition. It supervises, for electricity and natural gas, the transactions carried out between suppliers, traders and producers, the transactions carried out on the markets organized as well as the exchanges at the borders. It makes sure of the coherence of the offers of the suppliers, traders and producers with their economic constraints and techniques" .
CRE is made up of nine members named for six years: two of them (whose president) are named by the government, two by the president of the National Assembly, two by the president of the Sénat and one by the president of the Economic and Social Council. Its current president is Philippe de Ladoucette , previously chairman and managing director of French Coal Board, named on April 19th, 2006. The law of December 7th, 2006 modified the college of the police chiefs by the nomination of two vice-presidents among the police chiefs appointed by the presidents of the National Assembly and the Senate, and by the addition of two new police chiefs representatives the consumers.
The CRE is member of the Group of the European Regulators of Electricity and the Gas (ERGEG - European Regulators' Group for Gas and Electricity), created on November 11th, 2003, by the European commission. The ERGEG is charged to advise and assist the European commission in the realization of the interior market of energy, while taking part in implementation the complete of the directives and the European regulations in the sectors of electricity and gas.
The CRE adheres to the Conseil European regulators of energy (CEER, English initials Council off european energy regulator ), created the March 7th 2000, which gathers the regulators of the 25 Member States of the European Union, of the Norway and the Iceland.
