African Charter of the human rights and the people

the African charter of the human rights and the people is an international convention adopted by African countries within the framework of the Organization of African Unity (OAU).

History and context

The African charter of the human rights and the people was adopted the June 27th 1981 with Nairobi (Kenya) at the time of the 18th Conference of the Organization of the Africaine.
Unit It is coming into effect the October 21st 1986, after its ratification by 25 States.

It rests on the Charter of the Organization of African Unity and the Charte of the United Nations like on the Universal declaration of the human rights all “ taking account of the virtues of their historical traditions and the values of African civilization which must inspire and characterize their reflections on the design of the human rights and the people ” (preamble to the Charter).

Political tendencies

The first part states the rights recognized to any person “ without distinction no, in particular of race, ethnos group, color, sex, language, religion, political opinion or any other opinion, national or social origin, fortune, birth or any other situation ” (article 2). The first 18 articles define individual rights.

The following articles (19 to 24) define the rights of the people, considered as equal: rights to the existence, the free provision of their richnesses and their natural resources, with their economic development, social and cultural, with peace and safety and a satisfactory and total environment, favourable with their development. The charter condemns the Colonialisme and the economic domination.

Articles 27 to 29 state the duties which has any individual “ towards the family and the company, the State and the other legally recognized communities and towards the International community . ”

The second part creates a African Commission of the human rights and people charged to promote these rights and to assure their protection in Africa. She specifies her operation.

The third part is made up of various provisions, in particular the procedures of ratification and modification.
